Terms and Conditions
1. Acceptance of Terms
By accessing or using the services provided by Trinity Counseling and Wellness, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not access our telehealth platform or engage in our services. These terms constitute a legally binding agreement between you and Trinity Counseling and Wellness.
2. Telehealth Services
Trinity Counseling and Wellness provides trauma-informed counseling services exclusively via telehealth. Telehealth involves the use of electronic communications to enable our clinicians to provide services to clients who may not be in the same physical location. Our services are designed for adult clients seeking professional mental health support through a secure, HIPAA-compliant digital interface.
3. Eligibility and Location Requirements
Services are only available to individuals 18 years of age or older. Due to state licensing regulations, clients must be physically located in either Texas or California at the time of their scheduled telehealth appointments. By scheduling a session, you represent and warrant that you meet these eligibility criteria and will provide truthful information regarding your physical location during treatment.
4. Not Emergency or Crisis Care
Trinity Counseling and Wellness is not a crisis or emergency service provider. Our telehealth platform is not intended for use in emergency situations. If you are experiencing a mental health emergency, thoughts of self-harm, or are in immediate danger, please call 911 immediately or go to the nearest hospital emergency room. You may also contact the National Suicide and Crisis Lifeline by dialing 988.
5. No Medical or Legal Advice
The content published on our website, blog, and social media is for informational and educational purposes only. It is not a substitute for professional mental health advice, diagnosis, or treatment. Engagement with our digital content does not establish a therapist-client relationship. Furthermore, the information provided does not constitute legal advice. Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition.
6. Fees and Payment
You agree to pay all fees and charges associated with your account on a timely basis and according to the fee schedule provided at the time of intake. We maintain a secure payment processing system, and a valid credit card must be kept on file. By providing payment information, you authorize Trinity Counseling and Wellness to charge all therapeutic fees and applicable late fees to your chosen payment method.
7. Cancellation and No-Show Policy
Consistency is vital for therapeutic progress. We require at least 24 hours' notice for the cancellation or rescheduling of an appointment. Failure to provide 24 hours' notice or missing a scheduled session without notification ('no-show') will result in a fee equal to the full session rate. Repeated cancellations or no-shows may lead to a review of the clinician-client agreement or termination of services.
8. Insurance and Third-Party Payers
Clients are responsible for verifying their own insurance coverage and benefits. While Trinity Counseling and Wellness may assist in providing documentation for insurance reimbursement (superbills) upon request, the client remains ultimately responsible for all session fees. We do not guarantee reimbursement by any third-party payers or insurance companies.
9. Technology and Telehealth Risks
Telehealth relies on technology that can be subject to technical failures or security breaches. While we utilize HIPAA-compliant platforms to protect your privacy, risks include service interruptions, unauthorized access, or electronic malfunctions. Clients are responsible for ensuring they have a private space and a stable internet connection for their sessions to minimize these risks.
10. Limitation of Liability
To the fullest extent permitted by law, Trinity Counseling and Wellness and its clinicians shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use of our telehealth platform or services. You acknowledge that you use our services at your own risk and that mental health treatment often involves exploring challenging experiences which may cause temporary distress.

13. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
14. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the United States. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Texas or California, corresponding to the location where services were rendered.
